From what I've heard (I'm no expert)

If Nasri plays, he will only be cup-tied if Arsenal qualify for the CL. Since this is just a qualifier and not the competition proper, he wouldn't be cup-tied if they failed to qualify for the CL.

It's so that clubs can properly plan their finances for the year. Obviously a 30m payment makes a huge difference on a buy/sell decision.

If he's in the squad and plays we won't sign him simple as that. If they loose the game and go out anyway there are going to be some questions asked from all quarters I would imagine.
the squad was written before the first game....just a list you hand in so they know the players you could use

So, just to confirm, he's not cup-tied?
 
He will be cup-tied. The whole point of the rule is so that if you get knocked out of the cup you can't then go and join a club that's still in it. Whether it's a qualifier or not it doesn't matter (it's just another word for an earlier round), if Nasri plays and gets knocked out, then he can't play in it.

if nasri plays and we go out....he will not be cup tied

Just meet in the middle with these agent fees FFS, if he plays tomorrow it is going to get nasty.
