That's no longer true.
The rules were changed in the summer, so that retrospective action can still be taken if the initial punishment is not deemed harsh enough.

8 weeks isn't as bad as initially feared, but it still means he'll be out until mid March, that's in the region of 13 to 14 games he'll miss in all competitions, maybe more if we progress in the FA Cup.
This is where Jovetic needs to step up and get himself match fit. We need someone creative and attacking who can play in with Silva, and Jovetic could well fit the bill. He needs to get his fitness sorted and start contributing to the team. Milner simply doesn't have the skills of Nasri so if we're going to rely on him to carry the workload then we're going to slow down our goalscoring rate. Teams will concentrate on shackling Silva as they don't need to worry about Nasri.
