Pre Munich, City had not fulfilled that clause.
He may be keeping that up his sleeve, in his appeal to the FA.

I believe it's play in 10% across a whole season and sub appearances count, and it's a general standard of what constitutes constructive dismissal not Tevez's contract specifically. It's also games that they're available for. Given all those criteria I think we satisfy them comfortably. I also think Tevez couldn't argue constructive dismissal since he refused to play and then buggered off to Argentina without permission. That's gross misconduct, making the contract null and void and we'll be able to sue him. The only reason why we haven't gone down that road is that it'll be very hard to get the money. Chelsea are still pursuing Mutu for the £9.6m they were awarded. Easiest way to get our money is to sell him but I have no fear of Tevez walking on a free and suffering no repercussions.
 
It's a win win situation IMO. He comes in scores a few goals, helps us win the Premier League, his stock value goes back up to £40 million again, goodbye in the summer - SIMPLES.

Some fans i think are cutting off their noses to spite their face if they would rather see us finish second IMO. I could swallow that if it wasn't Manure who would probably win it if we DID finish second, and i have had enough of seeing those bastards plastic fans, walking round with their green & gold scarves, sharp viewcam shirts, and a lunchbox full of prawn sandwiches to last me a lifetime.

It's our time, and i want to see Vinny lift the trophy so i can ram it down every throat of each and every rag i know with or without Tevez!

But he fucked to Argentina without permission and is still there? That would negate that clause I'd imagine.

or some believe winning isn't everything and that winning with a side you can be proud of is more worthwhile. I wonder how some here got through the bad times if winning means so much to you.

The pro tevez camp seem to be of the opinion that no Tevez = 2nd, with Tevez = Title.

I don't see any reason to think this way?

And what if Tevez is brought back, plays some games and scores some 'important' goals but (God forbid) we don't win the league anyway?


Edit: PistonBlue just beat me to it and as he says, there are no guarantees with Tevez. Playing Tevez in any game would be a much greater risk than I would like to take.

Wigan penalty miss, Birmingham 1v1, Bayern, disappearing to Argentina, dissing the Club and the City, throwing our scarves away on the Wembley steps, laughing at our exit from the CL, transfer requests etc. What makes anyone think he would put any effort in for our benefit?

Which is exactly why we must back him if Bobby decides to give him a way back. We are wobbling at the moment and need something (someone) to give us a boost.

CT has been that man on many occasions and can beso again. Keep your eyes on the target (our first title for over 40 years) and dont worry about CT he is not important as an individual.
