I would also be very surprised if that case wasn't successfully argued against, at least in respect of the most serious allegations, and, quite possibly, in respect of all allegations.

while in theory i agree with you, 6 emails out of thousands with zero context attached to them which were illegally obtained do not constitute a forensic deep dive of our accounts going back fifteen years imo
