Not exactly an expert on the Spanish policing system but its good that 2 club employees personally appear to have witnessed this. Great evidence for any fans who need the clubs backing to sue the hell out of them.

A Bolton fan was on Radio Manchester and he said the same thing happened to him and his fellow fans when they were in Madrid to play Athletico. It does seem as if the Spanish police have a history of this kind of behaviour.
