Get the evidence as soon as possible. Send a copy of the results to Fletcher. In the meantime issue a summons.

on a serious note this is what i would do

wait for fletchers response and whatever punisment he gives.
gather your own evidence doctor or the freinds who were with you that day, after your ban has been completed asess your pre paid losses say three games is aprox £70.
inform fletcher you intend to seek recovery in full for your losses and any further losses which you may incur while attempting reccovery, give fletcher 30 days to respond and advise that if the amount is not paid you will refer to the county court for judgement.
after 30 days if fletcher has not responded or refunded you in full go to your local county court office and ask for the correct papers to issue a summons, you complete the forms take them back and the court will check them, 'i cant remember if they issue them or you do but they will tell you this' your damages should include the £70 above also any other financial losses like time off work etc.
i think the above would be enough to make them cough up pretty quickley esp if you advise fletcher you intend to speak to the manchester evening news aswell

i did this when parcelfarce ripped my front door off to leave a packet in the pourch its painless and cheap to do plus you have the last laugh

I have done trainging as a legal advisor for my job, that in my opinion would be jumping the gun a little. The court like to see that you have tried to resolve this yourself in a reasonable manner. Jumping straight into a summons is a little premature, and not all that reasonable. Yet.

A letter with strict, but not unreasonable time constraints, asking for the full policy on smokers in the stadium. Then you should also request the transcript or paperwork that explains your case and the evidence they have against you.

If all is as you say and you did not get a right to put your case across, then that ist going to bode well for them later on. Also if they havent got a full written report with signed statements from staff, same again.

I have a feeling that the Smokers policy will not specify a full ban in the first instance. It will also highlight the fact they do not allow you any chance to plead your case. If you can get written statements from friends family, anyone reputable confiming you do not smoke, or a doctors note if thats at all possible.

Once you have completed those steps it will give you a better idea of what you are dealing with, and they have a duty to provide you with this information, although they could charge you for Admin costs. Thsi will then give you more credability in court, since you can demonstrate you tried to resolve this issue in a reasonable manner without involving the courts. (they love that) Whilst also highlighting their policy.

Just because the club have xxxxx written in their T&C's that can not over rule your statutory rights. And in this case you have been banned without any right to reply and plead your case.

Also if they have no eveidence other than one person saw you, then its your word against their's, remember they need to prove you where smoking, its not for you to prove you where not.

Im not a solicitor, but have had some legal training. From what i can gather thats the correct way to move forward, as i builds you case, whilst asking them to reconsider.

1.Fans escorted out of the ground for having inappropriate wording on their banner. Banner has never been seen in the stadium since.

2. Fans escorted out of the ground for kicking a ball up in the air. Apparently a new club rule was introduced after the Villa FA Cup tie about returning the ball to the field of play from the terraces, but not a single fan was informed of this new rule.

3. Fans escorted out ground accused of smoking, even though 2 out of the 3 fans don't smoke and can prove it.

I would just like to give a special mention to SHOWSEC. That friendly rent a mob in yellow jackets, who rule the terraces of COMS with and iron fist, and who en-masse march City fans out of the stadium.

Sort it out Khaldoon and COOK.(that includes talking to Mr Fletcher about his job and his responsibilities) It really has gone beyond a joke now. You're treating City fans who are 'PAYING CUSTOMERS', with no respect whatsoever.

oh and dont forget my lad who got arrested for swearing, police charge was something hidious like caussing distress,trouble is they banned the wrong lad on the strength of a stewards word,they should have nicked the guy behind him so they said in the end,thats another who will never go back to coms

Sorry to any City fans who are Members of the Plod Brigade,but the old adage speaks in volumes here "Once a Cop,Always a Cop"
I have read all the posts about this guy Fletcher and on numerous other threads as well and this guy feels as though he is "revered" by the Club and those who work for him.
I feel the only way to get a message through to the hierarchy at Eastlands is to get the MEN involved and let the shit hit the fan (not a pun by the way) and as most decent law abiding citizens, lets take Fletcher and his heavy handed mob on.
He wants to play the big man,so lets see him stand in front of a Court of Law,as a defendent for a change and disprove the charges against him !!

I am 60 years of age,now Disabled, so can`t attend every home game,been watching the lads home and away since 1964,including hitch-hiking to Bilbao and the same season to the Final in Vienna.I have never been in trouble with any City staff in the 47 years of watching my Blues.
I am not a violent person,but my blood pressure rises like fuck,everytime I hear this mans name mentioned.
Any person from MCFC who reads this forum,please act now in the best interests of our LOYAL BLUE FANS, who it appears are constantly under severe pressure,to act out something which comes from the film 1984 !!!!!!!
To the OP and anyone else who has been subjected to gross negligence by Fletcher and his Nazi Followers,good luck in your quest to be proven as innocent victims.
I honestly wish I was in better health as I would have NO hesitation in starting a petition for signatures,to get something sorted once and for all.

I've just read all 18 pages and have to say I'm pretty disgusted. As I live in Spain I have come to realise that people in England accept far too much. It's time us, the fans, do something to fight back in this.

The minimum that any human being should be afforded is to have a reasonable opportunity to defend ones self. Peter Fletcher and his showsec cronies can get to fuck.

I just read all 18 pages of this as well and am pretty livid at it. It's no wonder atmosphere sucks at the matches most days you're not allowed to have atmosphere anymore. And I'll agree again having lived in England and the USA currently it amazes me what folks in England will accept. Fight back and do something about it! There's nothing more that an organization like City or any business hate more then negative press. You have a lot of resources at your disposal that are free, a lot of people willing to help you CAN fight back and take a stand. Do not let them homogenize City like they've done to MU!
